These Terms & Conditions (“Terms”) apply to all quotations, bookings, rentals, deliveries and hire agreements entered into with Popping Event Hire (“Popping”, “we”, “us” or “our”).
By requesting a quotation, making a booking, paying a deposit, accepting delivery or taking possession of any equipment from Popping, the customer (“you” or “the hirer”) agrees to these Terms.
These Terms are intended to apply to consumers for purposes of the Consumer Protection Act, 68 of 2008 (“CPA”), and are subject to applicable South African law.
If any provision is unclear, the hirer’s responsibility is to request clarification from Popping before accepting the quotation or proceeding with the booking.
1. Our Services
Popping Event Hire provides event furniture and equipment for hire, including items used for markets, exhibitions, activations, corporate events, private functions and other events.
Equipment available for hire is subject to availability and may vary from time to time.
A quotation or booking confirmation will specify the equipment, quantities, hire period, pricing and any applicable delivery, collection, setup or additional service fees.
2. Booking Confirmation
A booking is only confirmed once:
- Popping has accepted the booking; and
- The required deposit has been received.
A quotation does not constitute a confirmed booking and equipment will not necessarily be reserved until the booking requirements have been completed.
Popping reserves the right to decline a booking where equipment is unavailable, the proposed use is unsuitable, or other reasonable circumstances prevent Popping from accepting the booking.
3. Payment
A 50% deposit is required to secure a booking unless otherwise agreed in writing.
The remaining balance must be paid:
- Before equipment is collected, where collection is arranged; or
- Before or at the time of delivery, where delivery is arranged.
Popping may refuse to release or deliver equipment where the required payment has not been received.
All prices quoted are in South African Rand (ZAR) and will be subject to any applicable taxes, charges or fees as stated in the quotation.
4. Hire Period
Equipment is hired for the period specified in the quotation or booking confirmation.
The hirer agrees to return all equipment within the agreed return period.
The hirer may not retain equipment beyond the agreed hire period without prior approval from Popping.
Where equipment is retained beyond the agreed period, additional hire charges or late return fees may apply.
5. Ownership of Equipment
All equipment supplied by Popping remains the exclusive property of Popping Event Hire.
The hirer does not acquire ownership of any equipment through the hire agreement.
The hirer may not sell, pledge, lend, sub-hire, transfer ownership of, modify or otherwise dispose of Popping’s equipment.
6. Care of Equipment
The hirer is responsible for taking reasonable care of all equipment while it is in their possession or under their control.
Equipment must:
- Be used only for its intended purpose;
- Be used in a safe and reasonable manner;
- Not be altered or modified without permission;
- Not be exposed to conditions that could reasonably cause damage; and
- Be protected from theft, loss, unnecessary damage and misuse.
The hirer is responsible for the equipment from the time it is collected or delivered until it has been returned to and accepted by Popping.
7. Damage, Loss or Theft
The hirer may be responsible for the cost of repairing or replacing equipment that is damaged, broken, lost or stolen while in the hirer’s possession or control.
Replacement or repair charges may include reasonable costs associated with:
- Repairs;
- Replacement of damaged or missing items;
- Specialist cleaning;
- Transportation required as a result of damage;
- Recovery of equipment; or
- Other reasonable costs directly resulting from the loss or damage.
Where a security or holding deposit has been paid, Popping may apply the applicable amount toward these costs, subject to applicable law.
If the cost exceeds the security deposit, the hirer remains responsible for the outstanding amount.
8. Cleaning
Equipment must be returned in a reasonably clean condition.
The hirer may be charged a cleaning fee where equipment requires cleaning beyond normal cleaning associated with ordinary use.
A standard cleaning charge of R200 may apply where applicable.
Additional reasonable cleaning charges may apply where equipment has been returned excessively dirty or contaminated.
9. Late Returns
Equipment must be returned at the agreed time.
A R200 per day late return fee may be charged where equipment is returned after the agreed return time.
Additional reasonable costs may apply where a late return affects another customer’s booking, requires additional transportation or results in other direct costs to Popping.
10. Collection and Delivery
Where collection is selected, the hirer is responsible for collecting and transporting the equipment safely.
Where delivery is selected, the delivery fee and delivery arrangements will be specified in the quotation.
The hirer must ensure that:
- The delivery address is correct;
- Someone is available to receive the equipment;
- Suitable access is available;
- There is sufficient space for unloading; and
- The delivery team can safely access the agreed delivery point.
Additional charges may apply if delivery is delayed because the hirer or venue is not ready or accessible.
11. Setup and Breakdown
Equipment hire does not automatically include setup, styling, installation or breakdown services unless these services are specifically included in the quotation.
Where setup or breakdown has been requested, the scope and fees will be confirmed before the booking.
The hirer is responsible for ensuring that the event venue permits the required equipment and setup arrangements.
12. Outdoor Events
Where equipment is used outdoors, the hirer is responsible for ensuring that the event environment is reasonably suitable for the equipment.
The hirer should take appropriate precautions against:
- Rain;
- Strong winds;
- Extreme weather;
- Uneven surfaces;
- Mud or flooding;
- Unstable ground; and
- Other environmental conditions that may damage equipment or create safety risks.
Popping may refuse to deploy or may require the removal of equipment where weather or environmental conditions create an unreasonable safety risk.
13. Weather and Outdoor Events
The hirer acknowledges that outdoor events are subject to weather conditions.
Cancellation of an event because of weather does not automatically entitle the hirer to a refund.
Customers should consider appropriate contingency arrangements when planning outdoor events.
Where Popping determines that equipment cannot safely be delivered, installed or used because of dangerous conditions, Popping will communicate with the hirer and seek a reasonable alternative where possible.
14. Use of Equipment
The hirer is responsible for ensuring that equipment is used only for its intended purpose.
The hirer must not:
- Overload tables, furniture or equipment;
- Use equipment in an unsafe manner;
- Make unauthorised alterations;
- Attach permanent fixtures to equipment;
- Paint, drill, glue, staple or otherwise modify equipment;
- Use equipment for a purpose for which it was not designed; or
- Allow equipment to be used in a way that may cause unnecessary damage.
15. Responsible Adult and Supervision
Where the hired equipment requires supervision or responsible use, the hirer must ensure that a responsible adult or appropriately authorised person is present.
The hirer is responsible for supervising the use of the equipment by event attendees, employees, vendors, contractors and other persons attending the event.
16. Sub-Hiring
The hirer may not sub-hire Popping equipment to another person, business, event organiser or third party without Popping’s prior written approval.
Where Popping has agreed to a third-party arrangement, the original hirer remains responsible for the equipment unless otherwise agreed in writing.
17. Cancellation and Refunds
Bookings are subject to Popping’s Refunds & Returns Policy, which forms part of these Terms.
In particular:
- A 50% deposit is generally required to secure a booking.
- Cancellations made more than 7 days before the event may qualify for a refund, subject to applicable costs and the terms of the Refunds & Returns Policy.
- No refund will generally be payable for cancellations made within 7 days of the event.
- Bad weather does not automatically qualify a customer for a refund.
Nothing in these Terms is intended to remove or restrict any mandatory rights a consumer may have under applicable South African law.
18. Equipment Availability and Substitution
All equipment is subject to availability.
If a particular item becomes unavailable due to circumstances outside Popping’s reasonable control, Popping will endeavour to provide a suitable alternative where reasonably possible.
If no suitable alternative is available, Popping will communicate with the hirer regarding the affected item and any applicable refund or alternative arrangement.
19. Hirer’s Responsibility for Event Permissions
The hirer is responsible for obtaining any permissions, approvals or authorisations required for the use of equipment at the event venue.
This may include venue approval, access permissions, loading and unloading permissions, event-specific requirements and other permissions applicable to the event.
Popping is not responsible for obtaining venue permissions unless this service has been specifically agreed in writing.
20. Liability
Popping will take reasonable care in providing its equipment and services.
The hirer acknowledges that the use of hired equipment carries inherent risks and agrees to use the equipment responsibly and in accordance with its intended purpose.
Popping does not accept responsibility for loss, damage or injury caused by:
- Misuse of equipment;
- Failure to follow reasonable safety instructions;
- Unauthorised modification of equipment;
- Negligent use by the hirer or event attendees;
- Failure to properly supervise equipment;
- Use outside the equipment’s intended purpose; or
- Circumstances outside Popping’s reasonable control,
subject always to Popping’s obligations and liabilities under applicable law.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under the Consumer Protection Act or other applicable legislation.
21. Force Majeure
Popping will not be responsible for delays, cancellation or failure to perform its obligations where this results from circumstances beyond its reasonable control.
Such circumstances may include:
- Severe weather;
- Natural disasters;
- Fire;
- Flood;
- Government restrictions;
- Road closures;
- Civil unrest;
- Strikes;
- Major accidents;
- Power failures;
- Supplier failures; or
- Other circumstances that could not reasonably have been prevented or anticipated.
Where such circumstances occur, Popping will communicate with the hirer and endeavour to find a reasonable solution.
22. Quotations
Quotations are valid for the period specified on the quotation.
Unless otherwise stated, a quotation is not a guarantee that equipment will remain available after the quotation period.
Prices may change where the customer changes the equipment quantities, hire period, delivery requirements, event location or other booking requirements.
Any additional services or equipment requested after confirmation may result in additional charges.
23. Inspection of Equipment
The hirer should inspect equipment upon delivery or collection and notify Popping as soon as reasonably possible of any visible damage, missing items or issues.
Where equipment is delivered, the hirer should inspect the equipment before accepting it where reasonably possible.
Failure to immediately report an issue does not remove any rights the customer may have under applicable law, but prompt notification assists Popping in resolving problems quickly.
24. Privacy
Popping collects and processes personal information in accordance with its Privacy Policy.
By using our services, the hirer acknowledges that personal information may be processed for purposes including bookings, quotations, payments, deliveries, customer service, administration and other legitimate business purposes.
25. Changes to These Terms
Popping may update these Terms from time to time to reflect changes in our services, business operations or legal requirements.
The latest version will be published on our website.
The Terms applicable to a particular booking will generally be those accepted by the hirer at the time of booking, subject to any subsequent written agreement between the parties and applicable law.
26. Governing Law
These Terms are governed by the laws of the Republic of South Africa.
Any dispute arising from the use of Popping’s services will be dealt with in accordance with applicable South African law.
27. Consumer Protection
Popping is committed to complying with the Consumer Protection Act, 68 of 2008, where applicable.
Nothing in these Terms is intended to waive, limit or exclude any consumer right or protection that cannot legally be waived, limited or excluded.
