These Refunds & Returns Policy terms apply to all bookings and hire agreements entered into with Popping Event Hire (“Popping”, “we”, “us” or “our”) for the rental of event furniture, equipment and related items.
By making a booking with Popping Event Hire, the hirer (“you” or “the hirer”) acknowledges that they have read, understood and accepted this policy.
These terms apply to consumers for purposes of the Consumer Protection Act, 68 of 2008 (CPA) and are subject to applicable South African law.
1. Booking Deposits
A 50% deposit is required to secure and confirm a booking, unless otherwise agreed in writing by Popping Event Hire.
The booking is only considered confirmed once the required deposit has been received and the booking has been accepted by Popping.
The remaining balance is payable:
- Before the equipment is collected, where collection is arranged; or
- Before or at the time of delivery, where delivery is arranged.
Popping may not release or deliver hired equipment where the required balance has not been paid.
2. Cancellation of a Booking
We understand that event plans can change. However, because equipment is reserved specifically for your event date, cancellations may result in Popping losing the opportunity to hire those items to another customer.
Cancellation more than 7 days before the event
Where a booking is cancelled more than 7 days before the scheduled event date, the deposit may be refunded, subject to any costs already incurred by Popping in preparing, transporting or arranging the booking.
Cancellation within 7 days of the event
No refund will be payable for cancellations made within 7 days of the scheduled event date.
This is because the equipment has been reserved for the event and Popping may have declined other bookings for the same date.
Where exceptional circumstances apply, Popping may, at its discretion, consider a postponement or alternative arrangement, subject to availability and any additional costs.
3. Bad Weather
No refund will automatically be provided due to bad weather, including rain, wind or other adverse weather conditions, where the equipment has been reserved, prepared, transported or made available for the booking.
Where possible, customers should consider appropriate weather protection and alternative arrangements when hiring equipment for outdoor events.
If an item cannot safely be supplied or used because of circumstances outside Popping’s reasonable control, Popping will communicate with the hirer and determine an appropriate solution.
4. Returns
All hired equipment remains the property of Popping Event Hire at all times.
The hirer is responsible for ensuring that all hired equipment is returned within the agreed return period and in the condition in which it was received, allowing for reasonable wear and tear.
Returns must be made according to the collection or return arrangements confirmed at the time of booking.
No returns will be accepted outside the agreed return times without prior arrangement with Popping Event Hire.
5. Late Returns
Equipment that is returned late may prevent Popping from fulfilling another customer’s booking.
A late return fee of R200 per day may therefore be charged for equipment that is not returned within the agreed return period.
Popping reserves the right to charge additional costs where a late return results in a loss, additional transportation requirement or inability to fulfil another booking.
6. Cleaning Charges
The hirer is responsible for returning hired equipment in a reasonably clean condition.
Where hired items require additional cleaning because they have been returned excessively dirty, covered in food, drink or other substances, Popping may charge an additional cleaning fee.
A cleaning fee of R200 may be charged where applicable.
Where extensive cleaning is required beyond normal cleaning requirements, additional reasonable cleaning costs may apply.
7. Damaged, Broken or Missing Equipment
The hirer is responsible for all equipment while it is in their possession or under their control.
Replacement or repair charges may be applied where equipment is:
- Damaged
- Broken
- Lost
- Stolen
- Misused
- Returned in a condition requiring repair or replacement
The amount charged will depend on the nature and extent of the damage or loss and may include reasonable repair, replacement, cleaning or associated costs.
Where a holding deposit or security deposit has been collected, Popping may use that deposit toward applicable charges.
If the costs exceed the amount of the deposit, the hirer remains responsible for the outstanding amount.
8. Hirer’s Responsibility
The hirer agrees to take reasonable care of all equipment hired from Popping.
Equipment must only be used for its intended purpose and in a safe and appropriate manner.
The hirer is responsible for ensuring that suitable supervision is provided where required and acknowledges that use of hired equipment is at the hirer’s own risk, subject to Popping’s obligations under applicable law.
The hirer must not sell, sub-hire, modify, dismantle or otherwise dispose of Popping’s equipment without Popping’s prior written permission.
9. Collection and Delivery
Where the customer collects equipment, the customer is responsible for ensuring that the equipment is transported safely and securely.
Where Popping provides delivery, the delivery arrangements, delivery fee and delivery times will be agreed with the customer before the booking is confirmed.
Additional charges may apply where:
- Delivery access is restricted;
- The delivery location changes;
- The customer is unavailable to receive the equipment;
- Additional waiting time is required;
- Equipment needs to be moved further than the agreed delivery point; or
- A second delivery or collection attempt is required.
10. Event Setup and Collection
Unless specifically included in the customer’s quotation, standard equipment hire does not automatically include event setup, styling, dismantling or venue management.
Where setup or breakdown services have been booked, the scope and applicable fees will be confirmed with the customer.
The hirer must ensure that Popping’s delivery and collection team has reasonable access to the event location at the agreed times.
11. Equipment Availability
All equipment is subject to availability.
If Popping is unable to provide a specific item due to circumstances beyond its reasonable control, Popping will endeavour to provide a suitable alternative where possible.
Where an appropriate alternative cannot be provided, Popping will communicate with the customer and, where applicable, arrange a refund for the affected item or service.
12. Refund Processing
Where a refund is approved, refunds will generally be processed using the original payment method where reasonably possible.
Processing times may depend on the relevant bank or payment service provider.
Popping will not be responsible for delays caused by a bank, payment provider or other third party outside of Popping’s reasonable control.
13. No Unauthorised Returns
Equipment may not be returned to a third party, left at an unauthorised location or abandoned without prior approval from Popping.
The hirer remains responsible for the equipment until it has been received and checked by Popping or its authorised representative.
14. Exceptional Circumstances
Popping understands that exceptional circumstances can occur.
Where circumstances fall outside the standard cancellation and refund terms, Popping may consider the circumstances on a case-by-case basis.
Any alternative arrangement, postponement, credit or refund will be at Popping’s discretion, subject to the rights of the customer under applicable law.
15. Consumer Rights
Nothing in this policy is intended to limit or remove any rights that a consumer may have under the Consumer Protection Act, 68 of 2008, or any other applicable South African law.
Where a provision of this policy conflicts with a mandatory legal right, the applicable legal requirement will take precedence.
